Josh Dye Photography — Terms of Service

By clicking “I Agree”, you agree to the following Terms of Service with Josh Dye.
1. Scheduling & Contact
All appointments must be scheduled in advance. Any changes, postponements, or cancellations must be communicated directly to Josh Dye by phone, text, or email.
2. Cancellation & Rescheduling Policy
Full Refund: Cancellations made more than 24 hours before the scheduled appointment time will receive a full refund. Late Cancellation Fee: Cancellations made within 24 hours of the appointment will incur a 50% charge of the total job cost. No-Show: If the client or property is not ready for photography at the scheduled time and no prior notice has been given, the appointment will be treated as a late cancellation.
3. Property Readiness
Properties must be fully ready for photography at the start of the scheduled appointment time. If the property is not ready upon arrival — including ongoing cleaning, staging, or the presence of homeowners or tenants interfering with photographer — additional fees may apply or the appointment may need to be rescheduled which will incur a surcharge. Clients are responsible for ensuring access to the property and confirming it is clean, staged, and ready for media prior to the appointment.
4. Drone Operations (FAA Restrictions)
Drone use is subject to FAA regulations and local restrictions. In some areas, FAA LAANC waivers may be required. These requests require a minimum of 72 hours for processing. Exact appointment times are necessary for filing these requests as Josh Dye must put in specific time slots for these LAANC waivers. The property and client must be ready at the scheduled time. Josh Dye cannot guarantee FAA approval for any waiver request. Drone usage may be canceled or limited depending on FAA response or local airspace rules.
5. Matterport, 3D Virtual Tours & Video Shoots
Homeowners and tenants must be off the property for the entire duration of shoots requiring Matterport and/or video. This ensures accurate scanning and filming without interruptions. For properties requiring Matterport or 3D scanning, the property must be completely vacant for the duration of the shoot. This requirement specifically applies to the MLS Elite Package and the MLS Prime Package.
6. Additions & Changes to Orders
If additional media (e.g., video, drone, or Matterport) is added within 24 hours of the scheduled shoot, a surcharge may apply due to the short notice and extended session time. The total cost of the job will be adjusted accordingly.
7. Delivery Times
All media (except videos) is delivered within 24 hours of the shoot’s completion. Videos are delivered within 48–72 hours after the shoot. For an extra charge of $75, videos will be completed within 24-48 hours. This extended delivery time for video ensures the highest quality possible for your property video. Delivery times may vary slightly based on project size, weather, or for other unforeseen delays.
8. Payment Terms
Payment is due upon delivery of the final media. Accepted payment methods include Credit Card, check (checks must be given to Josh Dye in person), and Zelle.
9. Media Rights & Usage
All photos, videos, and other media remain the copyrighted property of Josh Dye until full payment is received. Upon full payment, the client receives a non-exclusive, perpetual license to use the media for their own marketing and promotional purposes only (e.g., MLS listings, social media, flyers, or agent websites). Media may not be shared, transferred, or licensed to third parties (builders/contractors, stagers, or other agents) without prior written consent from Josh Dye. Unauthorized third-party use may result in legal action.
10. Weather, Access, & Safety
If weather, airspace restrictions, or unsafe conditions prevent a shoot from taking place, Josh Dye reserves the right to reschedule, modify, or cancel the session. Clients are responsible for ensuring safe, accessible conditions at the property. Josh Dye reserves the right to refuse service if a location is unsafe or inaccessible.
11. Liability
Josh Dye is not liable for incidental damages, scheduling conflicts, or lost business resulting from delayed delivery, technical issues, or rescheduling due to uncontrollable circumstances (e.g., weather, illness, or FAA restrictions).
12. Agreement
